Employment & Migration Law
We have many years of successful and versatile experience in the field of labor and migration law.
We assist our clients with efficient achievement of their business objectives through proficient HR management, competent arrangement of labor relations with employees, inter alia, with corporate management by:
- assisting with setting up HR records management “from scratch”;
- conducting due diligence of labor relations, status of HR documentation and occupational safety system in terms of compliance with law in order to minimize Client’s risks of administrative sanctions;
- adapting international policies from the perspective of compliance with labor law for representative offices of foreign companies;
- examining employee labor agreements/contracts and suggesting ‘exclusive’ terms and conditions for labor contracts with corporate top managers;
- developing optimal and safest (for the Client) workplace management, employee compensation and bonus systems;
- providing consultation on streamlining the corporate structure, taking into account the Client’s interests, and following up on organizational/personnel measures from the position of compliance with the law;
- providing consultations and assisting with developing documents concerning termination of labor relations with employees on any grounds, inter alia, as a disciplinary measure;
- assisting with successful conduct and recording the procedure of corporate manager replacement, inter alia, in the event of dismissal in discrediting circumstances;
- providing consultations on issues of collective and material liability of employees for the purposes of safeguarding corporate property;
- assisting with development and introduction of the Customer’s commercial secret protection system;
- providing consultations and following up on preparation of documents in the event of involvement of the Client in any proceedings on labor law violations;
- representing the Client in court at reviewing and settling labor disputes (in this matter we are assisted by the Attorneys at law to whom we cooperate).
We assist our Clients with registering labor relations with foreigners in accordance with the law by:
- providing consultations on employment of Belarusian nationals abroad from the position of compliance with the migration law;
- providing consultations and assisting with registration of labor relations with migrant workers from the position of compliance with the law;
- following up on acquisition of required clearances in labor and social security agencies, as well as permissive documents in citizens and migration agencies for the purposes of employment of foreign nationals in Belarusian companies;
- following up on administrative procedures of legalizing temporary stay and residence of foreigners in the Republic of Belarus.
