Oksana has over 12 years of experience in advising on labour and migration law issues, including employment relations with employees, including foreign nationals, dismissal on various grounds, representing and defending clients in court, including labour and corporate disputes and recovery of damages from employees.

PROFESSIONAL EXPERIENCE:

• successful representation of the employer’s interests in courts of first and appellate instance in labour disputes, including disputes with company executives;
• advice and legal support for the replacement of top managers of companies, heads of representative offices of foreign companies and dismissal of employees on various grounds;
• support and preparation of documents on the division of authority and responsibility between a company’s CEO and other top managers;
• drafting employment contracts for remote employees, taking into account the interests of the employer; defining the procedure for interaction between the employer and such employees;
• advising on personnel optimisation and legal support for staff restructuring in more than 10 companies, preparation of related documents;
• personnel support of a representative office of a foreign corporation, adaptation of the corporation’s internal policies to Belarusian law;
• establishment of a system of protecting trade secrets in companies in various areas of activity: IT, manufacturing enterprise;
• implementation of a system of material responsibility of employees in a number of companies and successful representation of employers in court for recovery of material damage from employees;
• legal support in obtaining over 70 work permits and special permits for employment of foreign citizens in Belarus as well as permissions for temporary stay and residence of foreign citizens in Belarus;
• representation in court in cases concerning violation of legislation on legal status of foreign citizens and stateless persons;
• participation in the resolution of corporate conflicts between business owners;
• representing clients at general meetings of shareholders, in corporate conflict resolutions, in the Economic Court of Justice in cases of founders’ conflicts, challenging decisions of general meetings of shareholders;
• participation in due diligence of employment relations, corporate and registration documents of joint-stock companies.
